Salinas baton-beating officers cleared of wrongdoing


ON. THIS IS KSBW ACTION NEWS 8. DAN: GOOD EVENING, I’M DAN GREEN. ERIN: AND I’M ERIN CLARK. WE ARE BEGINNING TONIGHT WITH THE DISTRICT ATTORNEY’S DECISION TO CLEAR THE SALINAS POLICE OFFICERS INVOLVED IN JOSE VELASCO’S ARREST LAST MONTH. AN ARREST THAT HAS DIVIDED THE COMMUNITY. THE ARREST WAS CAUGHT ON TAPE. ACTION NEWS REPORTER LAUREN SEAVER IS LIVE WITH THE D.A.’S DECISION. LAUREN: THE VIDEO OF THE ARREST WENT VIRAL ALMOST OVERNIGHT. THIS IS THE VIDEO THAT SHOWS OFFICERS TAKING VELASCO INTO CUSTODY. WITNESSES HAD VARYING ACCOUNTS OF WHETHER VELASCO WAS TRYING TO HARM THE WOMAN IN THIS VIDEO, HIS MOTHER. MANY FEARED HE WAS TRYING TO THROW HER INTO TRAFFIC. WHILE VELASCO’S MOTHER SAID HE WAS NOT TRYING TO HURT HER. THE ARREST WAS VIOLENT, WITH AT LEAST ONE OFFICER USING A BATON. AND POLICE SAYING VELASCO RESISTED ARREST, WAS HIGH ON METH AND TRIED TO TAKE A TASER FROM ONE OFFICER. THIS AFTERNOON THE DISTRICT , ATTORNEY WEIGHED IN, CLEARING THE OFFICERS OF ANY WRONGDOING, STATING, “AFTER INDEPENDENT CONSULATIONS WITH TWO CERTIFIED INSTRUCTORS IN DEFENSIVE TACTICS USING BATON AND FIXED STICK WEAPONS, THERE IS INSUFFICIENT EVIDENCE TO PROVE ANY OFFICER COMMITTED A CRIME DURING THE INCIDENT.” POLICE CHIEF KELLY MCMILLIN ADDRESSED THE D.A.’S FINDINGS THIS AFTERNOON. WE ARE SATISFIED WITH THE DA’S FINDINGS. WE ARE CERTAINLY NOT HAPPY OF OUT — ABOUT HAVING TO USE FORCE. SOME PEOPLE THINK FORCE IS WAY TOO MUCH, EXCESSIVE FORCE THAT WOULD NOT ONLY OVERCOME BUT PUNISH. THAT WAS NOT THE CASE HERE. LAUREN: THE DISTRICT ATTORNEY’S STATEMENT DID NOT ONLY ADDRESS THE FINDINGS OF ITS INVESTIGATION INTO HOW POLICE HANDLED THE VELASCO INVESTIGATION. IT ALSO STATED THAT VELASCO WILL FACE THREE FELONY ASSAULT CHARGES ONE ON HIS MOTHER, ONE , FOR ASSAULT ON AN ARRESTING OFFICER AND THE THIRD FOR TRYING TO TAKE THAT OFFICER’S TASER. THERE’S ALSO A MISDEMEANOR CHARGE FOR ASSAULTING A FIREFIGHTER. VELASCO WILL BE IN COURT FOR ARRAIGNMENT ON THESE CHARGES TOMORROW. ERIN: LAUREN, THANK YOU. ACTION NEWS IS TRYING TO REACH VELASCO’S MOTHER TO GET HER REACTION TO TODAY’S NEWS; SHE HAS BEEN A VOCAL CRITIC OF HOW POLICE HANDLED HER SON’S ARREST.   1. At least "One"…..clearly you can't count or you're for some reason minimizing the actions of the Police. Very poor reporting.
